New York estate law questions

Can I contest a will in New York?

Yes, if you have standing and a ground. The grounds are lack of capacity, undue influence, fraud, and a signing that does not meet Estates, Powers and Trusts Law § 3-2.1. Disliking the will is not a ground.

An attorney-drafted will is harder, not immune. The contest is filed in the Surrogate’s Court where the will is offered. Contingency is how this office tries those cases.
