New York estate law questions

What is a small estate in New York?

A small estate is personal property of $50,000 or less. A voluntary administrator can collect it with an affidavit under Surrogate’s Court Procedure Act Article 13, without a full probate.

Real property does not go through that affidavit. If the house is in the decedent’s name alone, the will still has to be offered, or the heirs still have to be determined.
